PRIVACY AND DATA PROTECTION POLICY

This Privacy and Data Protection Policy (hereinafter the Policy) defines the regulation of the relationship between CHARITABLE ORGANIZATION “CHARITY FOUNDATION “UKRAINE FOR HEROES”, incorporated under the laws of Ukraine, located at Ukraine, Rivne, 16 Lypnia St. 6A, (hereinafter the UKRAINE FOR HEROES) and YOU (hereinafter the Data Subject) regarding the use of your personal data.

ALL DATA SUBJECTS ARE REQUIRED TO READ THIS POLICY TO UNDERSTAND HOW THE UKRAINE FOR HEROES COLLECTS AND PROCESSES PERSONAL DATA AND WHAT SECURITY MEASURES ARE BEING APPLIED.

While conducting its activities, the UKRAINE FOR HEROES adheres all conditions and requirements stipulated by the current legislation of Ukraine, European legislation including but not limited to the General Data Protection Regulation as well as by other international legislative acts concerning data protection.

 

  • DEFINITIONS

‘Personal data’ means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

‘Special categories of personal data’ (sensitive data) means personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade-union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

‘Data controller’ (controller) means a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

‘Data processor’ (processor) means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

‘Data Subject’ means any living individual who is the subject of personal data are processed by the Company, including Visitors, independent contractors/employees and other stakeholders.

 ‘Visitor’ means Data Subject who has entered the Website with any purpose.

‘Services’ means legal services provided by the Company.

‘Website’ means http://artarmor.org website.

‘Processing’ means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

‘Profiling’ means any form of automated processing of personal data intended to evaluate certain personal aspects relating to a natural person, or to analyses or predict that person’s performance at work, economic situation, location, health, personal preferences, reliability, or behavior. This definition is linked to the right of the data subject to object to profiling and a right to be informed about the existence of profiling, of measures based on profiling and the envisaged effects of profiling on the individual.

‘Automated decision-making’ means an ability to make decisions by technological means without human involvement that produces legal effects concerning tha Data Subject or similarly significantly affects the Data Subject.

‘Personal data breach’ means a breach of security leading to the accidental, or unlawful, destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored or otherwise processed.

‘Consent’ means any freely given, specific, informed and unambiguous indication of the Data Subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data.

“Cookies” files are text files sent by websites to computers or other user’s devices with Internet connection exclusively for identifying the web browser of the user or store information or settings in the browser.

 

  •  STATEMENT
    • In collecting and using of the personal data, the UKRAINE FOR HEROES is subject to a variety of the legislation controlling how such activities may be carried out and the safeguards that must be put in place to data protect.
    • This Policy applies to all UKRAINE FOR HEROES employees, independent contractors, stakeholders and all other subjects that directly or indirectly participate in the personal data processing, including Data Subjects who visit the website  http://artarmor.org, within UKRAINE FOR HEROES activities.
    • This Policy sets out how the UKRAINE FOR HEROES uses, processes and stores the Data Subjects’ personal information. The UKRAINE FOR HEROES will obtain that information from Data Subject with his/her permission and consent, or may receive personal data from Social media to whom Data Subject has given consent to pass this information on to the UKRAINE FOR HEROES according to this Policy.
    • The Data Subjects have a right to apply to the UKRAINE FOR HEROES about his/her personal data breach if he/she becomes aware of it earlier than the UKRAINE FOR HEROES.

 

  • PRINCIPLES OF PROCESSING
    • During collecting and processing the personal data, the UKRAINE FOR HEROES adheres the principles provided by the GDPR. The UKRAINE FOR HEROES policies and procedures are designed to ensure compliance with the principles:

(a) Lawfulness, fairness and transparency

Lawfully – the controller identifies a lawful basis before to process the personal data (for example consent).

Fairly – in order to process fairly, the controller has to make certain information available to the data subjects as practicable. This applies whether the personal data was obtained directly from the data subjects or from other sources.

Transparently – any information and communication relating to the processing of the personal data be easily accessible and easy to understand, and that clear and plain language be used.

(b) Purpose limitation

The personal data must be collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall, not be considered to be incompatible with the initial purposes.

(c) Data minimization

The personal data must be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

(d) Accuracy

The personal data must be accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay.

(e) Storage limitation

The personal data must be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed. Personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, if only are implementated appropriate technical and organizational measures required by the GDPR in order to safeguard the rights and freedoms of the data subject.

(f) Integrity and confidentiality

The personal data must be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.

 

  • COLLECTED PERSONAL DATA AND PURPOSES OF PROCESSING
    • The UKRAINE FOR HEROES collects and processes only the personal information provided by Users voluntarily or in case this information is necessary for providing (improving) the services to the customer. The UKRAINE FOR HEROES collects both basic personal data such as name, surname, patronymic, e-mail address, phone number etc, and secondary (technical) data, i.e. cookies, information on connection and system information etc.
    • Visitors are entitled not to provide this information to the UKRAINE FOR HEROES, but in this case, the Website may operate improperly, or some functions may be unavailable.
    • The UKRAINE FOR HEROES collect Personal Data for the following reasons:

  • To provide you with email alerts, event registrations and other notices concerning our products or services, or events or news, that may be of interest to you.

  • The UKRAINE FOR HEROES gets Visitors personal data from cookies. A cookie is a text string that the Platform transfers to the cookie file of the browser on Visitor’s computer. The Company uses cookies to personalise content and ads, analyse its traffic. The UKRAINE FOR HEROES uses the following information for determined purposes:

The UKRAINE FOR HEROES may also receive information about Data Subject from social media platforms including but not limited to when he or she interact with the UKRAINE FOR HEROES on those platforms or access its social media content. Such information is governed by the privacy settings, policies, and/or procedures of the applicable social media platform, and we encourage you to review them.
  • The UKRAINE FOR HEROES does not collect and/or process the sensitive data.
  • While processing personal data, the automatic decision-making and profiling is not applied by the UKRAINE FOR HEROES.
  • The UKRAINE FOR HEROES does not collect from Data Subjects more personal data than it is determined in this Policy. The UKRAINE FOR HEROES also does not collect more personal data than it is needed for the purposes of processing specified herein.

 

  • THE LAWFULNESS OF PROCESSING
  • The Visitors personal data are being collected while the appropriate Visitor is entering the Website. Herewith, the personal data are being collected, because such data processing necessary for the pursuation of the legitimate interests of the UKRAINE FOR HEROES. Also the UKRAINE FOR HEROES may process Visitors personal data on the basis of the consent.

 

  • USER AGE
  • The UKRAINE FOR HEROES collects the personal data on the basis of consent obtained from the Data Subjects who have reached the age of 18 years.

  • WITHDRAWAL OF CONSENT
  • The Data Subject is entitled to withdraw the consent at any time he/she wishes. The withdrawal of the consent is considered to be properly made after the Data Subject has sent appropriate letter of withdrawal to the next e-mail address: artarmor.org@gmail.com. 
  • The appropriate request for withdrawing of the consent shall be examined within 72 hours since a moment the respective form of withdrawal is received, and the adequate decision will be made by the UKRAINE FOR HEROES.

 

  • THE PERIOD OF STORAGE
  • The  UKRAINE FOR HEROES processes and stores the personal data during the period that is needed for realization of the processing purposes, specified in this Policy.
  • Taking into account the purposes of processing, the period of storage of the personal data (period of storage) is 12 months.
  • After an expiration of the period of storage, the  UKRAINE FOR HEROES is obliged to delete the personal data or ask the Data Subject to provide the  UKRAINE FOR HEROES with a new consent, if the necessity of processing remains actual for the  UKRAINE FOR HEROES or another purpose of processing appears.
  • The  UKRAINE FOR HEROES is entitled not to store more and delete the earlier collected Data Subject personal data of at any time if such personal data are not needed more. Herewith, the  UKRAINE FOR HEROES is obligated to notify the respective Data Subject that his/her personal data are deleted.
  • The  UKRAINE FOR HEROES may keep storing the personal data if a subsequent processing is foreseen by law and is deemed relevant for a purpose which is not compatible with the original purpose of processing stated in this Policy. Herewith, under the incompatible purposes means the purposes concerning archiving in the public interest, scientific, statistical or historical use.

 

  • PROCESSORS
  • While processing the Visitors personal data, the UKRAINE FOR HEROES may engage Google Inc. (by using Google Analitycs) as processor.
  • The UKRAINE FOR HEROES is responsible for the proper processing of the Users personal data under the GDPR. Herewith, each processor is responsible for the adherence of the GDPR as well as for other legislative actions concerning data protection while processing the Users’ personal data.
  • The processors are not entitled to define any additional purposes for the personal data processing.

 

  • DATA SUBJECTS RIGHTS
    • This Policy provide all Data Subjects with opportunity to realize any of the following rights:

right to access. The Data Subjects have a right to know whether their personal data are being processed and if so, access such data.

right to rectification. If the personal data are inaccurate, the respective Data Subject is entitled to ask the UKRAINE FOR HEROES to correct them indeed.

right to erasure or right to be forgotten The Data Subjects have a right to obtain from the UKRAINE FOR HEROES the erasure of the Data subjects’ personal data without undue delay and the UKRAINE FOR HEROES has the obligation to erase such personal data without undue delay.

right to restriction of processing. The Data Subjects have a right to limit processing of their personal data with several exceptions under the scope of the GDPR.

right to be informed. The UKRAINE FOR HEROES obliged to inform Data Subjects what data is being collected, how it’s being used, how long it will be kept and whether it will be shared with any third parties. This information must be communicated concisely and in plain language.

right to data portability. The Data Subjects are permitted to obtain and reuse their personal data for their own purposes across different services. This right only applies to personal data that Data Subject has provided to the UKRAINE FOR HEROES by way of the consent.

right to object. The Data Subjects can object to the processing of personal data that are being processed by the UKRAINE FOR HEROES. The UKRAINE FOR HEROES must stop processing personal data unless the UKRAINE FOR HEROES can demonstrate compelling legitimate grounds for the processing that overrides the interests, rights and freedoms of the individual or if the processing is for the establishment or exercise of defense of legal claims.

right not to be subject to a decision based solely on automated processing. The Data Subjects have a right to object to any automated profiling that is occurring without consent. Herewith, the Data Subjects have a right their personal data are to be processed with the human involvement.

  • The Data Subject can realize any of described above rights by sending request to the e-mail address: artarmor.org@gmail.com. Data Subject request must include name, contact information of the Data Subject, right which Data Subject wants to realize, personal data processed by the UKRAINE FOR HEROES, details and reason/justification of such request.
  • These are the timescales within which the Data Subjects may realize its rights, stated above (the period starts from the moment the UKRAINE FOR HEROES receives the request):

  • SECURITY
    • The UKRAINE FOR HEROES is responsible for ensuring that any personal data that UKRAINE FOR HEROES holds and for which they are responsible, is kept securely and is not under any conditions disclosed to any persons unless that persons has been specifically authorized by UKRAINE FOR HEROES to receive that information and has entered into a confidentiality agreement.
    • All personal data should be accessible only to those who need to use it under internal documentation of theUKRAINE FOR HEROES. The personal data shall be treated with the highest security and must be kept encrypted.

 

  • DATA BREACH NOTIFICATION
    • The UKRAINE FOR HEROES takes all reasonable steps to minimize the risk of the personal data breach while processing the personal data.
    • In the case of a personal data breach, the UKRAINE FOR HEROES shall without undue delay and, where feasible, not later than 72 hours after having become aware of it, notify the personal data breach to the Data Protection Authority, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of the Data Subjects.
    • The risk assessment the UKRAINE FOR HEROES has to carry out will have determined whether the risk to the rights and freedoms of the data subjects affected is judged to be sufficiently high to justify notification to them.
    • Also, in the case of a personal data breach, which is likely to result in a high risk to the rights and freedoms of the Data Subjects, the UKRAINE FOR HEROES shall without undue delay notify the appropriate Data Subject the personal data of which were breached.
    • If measures have subsequently been taken to mitigate the high risk to the Data Subjects, so that it is no longer likely to happen, then communication to the Data Subject is not required by the GDPR.
    • The UKRAINE FOR HEROES documents all personal data breaches, comprising the facts relating to the personal data breach, its effects and the remedial action taken. That documentation shall enable the Data Protection Authority to verify compliance with the GDPR.
    • The respective processor is obligated without undue delay to notify the UKRAINE FOR HEROES about the breach of the personal data while processing such personal data under the UKRAINE FOR HEROES instructions.

 

  • DATA TRANSFER
    • The UKRAINE FOR HEROES stores personal data in Ukraine.
    • The UKRAINE FOR HEROES does not sell, trade or transfer personal data to any legal persons or individuals.

 

  • ADDITIONAL CONDITIONS
    • The UKRAINE FOR HEROES may revise this Policy from time to time. If the UKRAINE FOR HEROES makes material changes to this Policy, it will notify the Data Subjects by posting a notice on the Website. By continuing to access or use the Website, Visitors agree to the revised Policy.

ArtArmor and Lviv Defense Cluster exchange “shots” armor plates for new body armor

The founder of the art project ArtArmor, Oleksandr Kovalchuk, and the Chairman of the Board of the Lviv Defense Cluster (LDC), Maksym Plekhov, on the air “Suspilne. News” talked about the launch of the program to exchange armored plates that saved lives for new armored vests.

 

According to Maksym Plekhov, the essence of the idea is that the defenders of Ukraine, who have damaged armor plates and the history of how it saved their lives, hand over their “used” protective equipment to the. Lviv Defense Cluster.

 

In return, the defense company will send them new armor plates and plate carriers, and the damaged armor will be given to the ArtArmor team to be turned into art objects.

 

At the same time, the founder of ArtArmor Oleksandr Kovalchuk emphasized that not only the armor plate that saved a person’s life, but also the story of the rescue is important to us. This story will be used by artists in the future when creating an art object.

 

Nova Poshta, a well-known Ukrainian company and one of ArtArmor’s key partners, also participates in the armor plate exchange program. Thanks to its support, the defenders of Ukraine can send their armor plates to the Lviv Defense Cluster free of charge, and new means of protection will also be delivered to them free of charge. We are very grateful to Nova Poshta for its support!

Art that saves lives. Surprisingly, this wording is literal, not metaphorical, when it comes to ArtArmor project.

 

ArtArmor is a truly unique project: it combines seemingly incompatible, sometimes even antagonistic phenomena: art and militarism. Or, more precisely, armor plates, protective equipment of the Ukrainian military, which, due to being hit by enemy bullets or fragments, is no longer suitable for use in combat conditions.

 

But even these broken and mutilated plates continue to defend life – already within the the ArtArmor project, which gives a second chance to fulfill the protective mission. They become the basis for art objects created by artists well-known in Ukraine and abroad. Now the former armor plates have a new rescue mission – thanks to the funds from the sale of these unsurpassed art objects by the best artists of Ukraine. Every Euro from the sale of works will go towards the purchase of the most necessary things for our soldiers at the front.

 

The countdown to the ninth month of Ukraine desperately fighting for its right to a free and peaceful life has begun. This test united not only Ukrainians, but also people from all over the world, for whom free will, the right to self-determination, and the right to freedom of speech, religion, and life are the most important values. Schoolchildren and IT workers, businessmen and housewives, pensioners and cooks, priests and dancers – everyone contributes to our victory over a vile and treacherous enemy. And artists do not remain aloof from this great humanitarian cause.

 

Since ancient times, art has had its own, unique way to hearts and minds. Using the means of artistic expression, addressing the existential questions, it serves as s a guide to ideas, to important human values, the most essential – which is life. Freedom, security, and independence are integral attributes of a dignified existence, which every conscious person in the world aspires to. History has taught us that they are priceless and that they are inviolable rights of any person, nation, and country. Unfortunately, Ukraine currently has to defend these rights in a fierce struggle with the aggressor.

 

The ArtArmor project is called to join this struggle, to take a personal part in achieving true independence for our country. Art is a universal visual language, saturated with meanings and allusions, it has a distinct aesthetic and carries a powerful emotional charge. That is why the language of art knows no borders – it is understandable to every person in any corner of the world. In the ArtArmor project, we use the language of art to highlight one simple truth against the background of today’s tragic events: the most important thing in this world is the value of human life. That is why we chose an extremely metaphorical medium to convey this idea – protective armor plates that were damaged while fulfilling their direct mission – to save the lives of soldiers.

 

Using these armor plates to create their artworks, artists breathe new meaning into the spent, burnt metal, and imbue a dead thing with a life-giving idea.

 

Many Ukrainian artists have joined and continue to join the ArtArmor project – recognized, talented ones whose works resonate with the hearts of many art lovers all over the world. They gladly responded to the offer to convey the idea of the priceless of life to the whole world through art.

 

Working on the project was difficult and… easy at the same time. It was easy because ArtArmor is meant to help and protect, and it adds strength even when it seems you lack it.

 

The difficult part was related to the heart full of pain when the used plates “told” the stories of the fighters they protected. Damages on metal surfaces seem to still carry the destructive energy of a shot, aggression, and violence. These armor plates are like guardian angels who accepted a blow to save human life. So that ordinary people, who were forced to leave their peaceful, calm lives and stand up for the defense of their native country, could once again dream, breathe, love, worry about loved ones, hope for the best, plan a happy future in a peaceful world…

 

The courage and dedication of our fighters, who are currently tirelessly protecting the peace, without exaggeration, of the whole world, inspire all the team members as well as the central idea fulfills artists with energy and creative drive.

 

Created by a different artist, each artwork is unique and tells its own story. But there is something common for all of them – the undeniable talent of their creators and the extremely powerful energy charge of these works. Each artist used his own metaphor, but it invariably leads us to an axiomatic conclusion: there is nothing more valuable in the world than human life.

 

This awareness will give the present civilization a future. A future without military conflicts, senseless deaths, and tragic consequences. A future in which conflicts will be resolved purely in the cultural field and by cultural means. May art be the only weapon of mankind in this future. A weapon of freedom, independence of the manifestation of human genius, and self-expression. May our world become a territory where there is a place for everyone despite of their race and nationality, religion, and views. Where each person is valued for his/hers uniqueness, and human life is a priceless and inviolable right of everyone. Actually, the ArtArmor project is about this.

“Colors of Victory”. ArtArmor has announced a competition for children 12-17 years old

Ukrainian artists and philanthropists invite children of the Rivne region aged 12-17 to take part in the Colors of Victory art competition, which is held as part of the charity art project ArtArmor.

 

The following information is published on the ArtArmor Facebook page.

 

According to the terms of the competition, the work must be done in A3 format (30×40 cm), and applications for participation are accepted until April 30, 2023 – for this, you need to fill out the appropriate form.

 

“The winner of the competition will recreate the plot of his work on the armor plate that saved the life of a soldier who defends Ukraine,” the organizers note.

 

For reference: ArtArmor is an international art project that was founded in the Rivne region. Within the framework of this project, Ukrainian and foreign artists create art objects from armored plates that saved human lives by stopping bullets, debris, etc. In this way, ArtArmor draws the attention of the whole world to Russia’s war against Ukraine and collects money for the purchase of new armor plates and other means of protection, for humanitarian demining of the territory of Ukraine, as well as for the treatment and rehabilitation of wounded defenders of Ukraine.

 

It is reported that the children who will take the first, second, and third places will have the opportunity to take part in the grand opening of the exhibition and present the works of all the participants of the “Colors of Victory” competition. The exhibition will be held in Kyiv – at the National Museum of the History of Ukraine in the Second World War.

 

“At this event, young creators will have the opportunity to meet and talk with the artists of the ArtArmor project, whose art objects will be traveling around the capitals of Europe from January 2023,” the organizers write.

 

On the same day when applications for participation in the “Colors of Victory” contest were opened, the founder of the ArtArmor art project and co-founder of the charity fund Ukraine For Heroes Oleksandr Kovalchuk, and the teacher of the art studio at the art gallery “EuroArt” Oleksandra Overchuk gave an interview to Ukrainian Radio Rivne, in which they spoke in detail about the competition.

 

Oleksandr Kovalchuk said that the “Colors of Victory” competition is held among children from Rivne and Rivne Region, as the ArtArmor project was founded in Rivne. At the same time, he emphasized that an all-Ukrainian competition may be held in the future, but before that, it must be successfully implemented on the scale of the Rivne region.

 

“Given that our entire Art-Armor project and the charity fund “Ukraine for Heroes” were founded in the Rivne region, in the city of Rivne – we are conducting such a “test” contest precisely on the territory of the Rivne region. And if it is successfully held, as we see – with good and good results – we plan o continue the work of this competition already throughout Ukraine,” said Oleksandr Kovalchuk.

 

Oleksandra Overchuk, the teacher of the art studio at the art gallery “EuroArt”, spoke in detail about whether there are any requirements for the participants of “Colors of Victory” and what exactly is expected of them.

 

“Every child is talented, so art education is not the main criterion of our competition. It is not necessary to have any specific abilities that were developed based on some studio or school. A child should simply have his vision of our victory, the colors of victory. A child should create their image that has not been shown anywhere before, neither virtually nor at exhibitions,” said Oleksandra Overchuk.

 

The winners of the competition will be determined by the jury – the organizers have already published detailed information about its composition.

 

Yes, participants’ works will be evaluated:

  • Anton Logov is a well-known Ukrainian artist who works in the fields of painting, graphics, sculpture, video art, and installation. Member of the art project ArtArmor.
  • Max Kidruk is a famous Ukrainian writer from the Rivne region, the author of several travelogues and many novels, including “Until the light goes out forever”, “Where there is no God”, “Look into my dreams” and others.
  • Kostyantyn Kachanovskyi is a well-known muralist from Rivne, who after February 24 created many patriotic and morale-boosting murals throughout Ukraine.
  • Oleksandr Kovalchuk – founder of the ArtArmor art project and the charity fund Ukraine For Heroes, People’s Deputy of Ukraine.
  • Anna Vitruk – director of the modern art studio “Euro-Art”, co-organizer of the “Colors of Victory” contest.
  • Iryna Pervushevska is the director of the Rivne City Palace of Children and Youth, under whose leadership the institution raised and continues to raise creative personalities.

 

The organizers of the competition expect that many children will take part in it because it is a good opportunity for young talented artists to show their creativity throughout the country.
